Article 1: Application of the general conditions of sale

These conditions (hereafter GTC) apply to any sale of product between Traditions & Innovations (SARL with capital of 210,000 Euros, whose registered office is 1 chemin de la boule, 66240 Saint-Estève; N ° identification: 490082013 00049 RCS PERPIGNAN) hereinafter called Bagavin.com-Traditions & Innovations SARL and its customers from the Internet storewww.Bagavin.com.

They are available to the buyer on the home page of the websitewww.Bagavin.com. Placing an order implies acceptance by the buyer of the C.G.V., to the exclusion of any other document such as a prospectus or catalog issued by the seller, the value of which is only indicative. Any possible modification of the C.G.V. will only apply to sales concluded after the modification, the dates appearing on this page and on the notice of receipt of the order sent to the buyer being authentic. The offers of the site are reserved for private and professional customers.

Traditions & Innovations SARL reserves the right, for all new customers, to ask them for proof of identity and address, before the final validation of their first order.

 

Article 2: Prices

  1. Bagavin.com-Traditions & Innovations SARL reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the registration of orders.

  2. The prices are inclusive of VAT, in euros, excluding shipping costs.

  3. The fixed transport prices in Europe, outside of France, are:     22 Euros including tax per unit ordered

Article 3 : Content of the order

The order must strictly comply with the offer as issued on the site and in particular the formats, quantities offered and deadlines.

Article 4: Stages of the order

  1. The order implies prior knowledge by the customer of these conditions, the price and essential characteristics of the products chosen, available on the site.

  2. The order is taken via the dematerialized order form available online on the Bagavin.com site.

  3. The buyer communicates the requested information, necessary for the completion of the sale, in the "My Account" area. He takes care on this occasion not to omit any information essential for the proper execution of the delivery, such as a possible access code to the building.

  4. The buyer is identified by his e-mail address and his personal password.

  5. The buyer accepts the order by clicking on "check out" after choosing the payment methods and entering the information requested to enable it, in the areas provided for this purpose. Its acceptance is then final, subject only to the possible exercise of its right of withdrawal described on the specific page on this site.

  6. Bagavin.com confirms the order to the buyer by e-mail summarizing the latter, as well as the procedures for exercising the right of withdrawal, the address of the seller's establishment with which the buyer can present his complaints and information relating to after-sales service and commercial guarantees.

  7. All orders are considered firm and final, after receipt of payment and confirmation by our services.

 

Article 5: Payment date

  1. Any deliverable order can only be validated if it is accompanied by the payment (bank card, transfer) of the full price including tax and shipping costs.

  2. In the absence of receipt of the transfer by Traditions & Innovations SARL no later than ten days after the order, it is automatically canceled.

 

Article 6 : Payment methods

  1. By bank card, in Euros, (Visa Card, Eurocard / Mastercard) indicating in the area provided for this purpose (secure entry by SSL encryption) the number of your card, without spaces between the numbers, as well as its date and the three-digit security number on the back of your card.

The information is encrypted and undecodable. Traditions & Innovations SARL does not have access to it, only the acknowledgment of the correct transaction of your payment reaching us.

Article 7 : Transfer of ownership

Any risk of loss or damage to the goods is transferred to the consumer when the latter or a third party designated by him, and other than the transporter proposed by the professional, takes physical possession of these goods.

 

Article 8 : Availability of the goods

Offers are always made subject to the quantities available. In case of unavailability of the ordered products and subsequent cancellation of the order, the price will be refunded to the buyer as soon as possible

 

Article 9 : Destruction

In case of destruction of the goods before the date scheduled for the delivery of the order, in the absence of available stock to replace it, the buyer will be reimbursed for the sums paid by him, excluding any other compensation, within 30 days from the date of the incident.

 

Article 10 : Delivery

The order specifies the place of delivery where the buyer must receive the goods. Any modification to the place of delivery must be indicated by the buyer to the seller in good time and in any event before the order is taken over by the carrier.

 

The indicative standard delivery time is maximum 10 working days if the order does not contain a logo and between 15 to 20 working days if the order contains a logo. The order is processed within 24 hours of the validation of the order, Monday to Friday, between 9 a.m. and 6 p.m., except in exceptional circumstances.

If, exceptionally, the buyer should note the absence of delivery within the deadlines indicated above, he should immediately notify Bagavin.com -Traditions & Innovations SARL to allow him to remedy the problem as soon as possible, the execution of the order must then intervene at the latest within 30 days of the latter. Exceeding delivery times cannot give rise to any damages.

The presentation of the goods at the place and on the date indicated by the buyer releases the seller from his obligation of delivery. In the absence of the buyer during the presentation of the goods, as far as possible and according to the circumstances, the last transport company will contact the buyer to inform him of the possibilities and possibly of a second delivery, provided, however, that the latter has communicated a telephone number allowing him to be reached during the day.

The buyer is required to check the condition of the packaging and the content of the package (s) upon delivery. In case of damage or lack of conformity, the buyer is imperatively obliged to express reservations on the delivery slip, specifying the anomalies noted, and to notify Bagavin.com-Traditions & Innovations SARL within three days, not including public holidays, from the receipt of the products, by email and by registered letter. If a breakage is noted, the buyer must refuse the damaged package, indicate it on the delivery note of the carrier and inform Bagavin.com-Traditions & Innovations SARL in the above conditions. When the buyer personally takes delivery of the transported objects and when the valet does not justify having given him the opportunity to actually check their good condition, the period mentioned in article L. 133-3 of the Commercial Code which extinguishes any action against the valet is increased to ten days. The seller, Bagavin.com-Traditions & Innovations SARL is under no obligation, but invites you to contact its services as soon as possible to explain the problem and the situation.


Precision: In the event of a DAMAGE, you must formulate characterized reservations * on the delivery slip. The mention "subject to unpacking" does not constitute a characterized reservation and has NO LEGAL VALUE. It is therefore essential that you describe precisely the condition of the packaging and / or your product. (Ex: Breaking noises, Parcel open, damaged, torn, pressed packaging… on the bottom right corner, scratched, pressed product on the left side…).

 

You must also confirm by registered mail these reservations to the carrier at the latest within 3 working days of receipt of the item (s), and send a copy of this mail to: SARL Tradition & Innovations, 1 chemin de la boule, 66240 Saint- Estève, FRANCE, remembering the references on the delivery slip. Note: The verification of the condition of your product is considered to have been carried out once the delivery slip has been signed.


General return procedure and conditions

For the purpose of identification and therefore optimal processing of returns, any product needing to be returned to Bagavin.com-Traditions & Innovations SARL, must be subject to a return request to our Service via an email to the email addressti.bagavin@gmail.com, under penalty of being refused. A return agreement number to affix to your package is communicated to you in acceptance of a return request. The time limit set for you to contact our Customer Service depends on the reason for the return, in accordance with the provisions of these General Conditions of Sale.

The return address and the carrier to be used will be communicated to you by email.
The product must be returned in good condition and in its original packaging, even if the latter has been opened, all of the products to be returned will be treated on a case-by-case basis but may include all of the products sent (accessories, instructions ...).

Processing your return for reference error :
Depending on the nature of the product, availability and your wishes, we will determine together with an agreement before any return from you. The following cases will be considered: re-shipment of the product originally ordered, exchange for a product with equivalent characteristics.

Return costs: for reference errors the company SARL TRADITIONS & INNOVATIONS covers all return costs but will indicate to the customer the carrier to use.

Processing of your return for error in delivery address or for non-complaint with the carrier :
If all or part of the delivery addresse prove to be incorrect, obliging Bagavin.com-Traditions & Innovations SARL to return orders to its warehouse, it is up to the CUSTOMER to bear all the consequences (delay in delivery, possible repercussions on cost transport…). Our services will contact you to resolve the problem.

Treatment of a non-distribution for reason of "spoliation"
After receiving and accepting your return package on our logistics platform, depending on the nature of the product, availability and your wishes, we will offer to resend the product originally ordered or an exchange product with equivalent characteristics. Otherwise, a voucher will be credited to your customer account within 48 hours of receiving your package. It will correspond to the amount of the entire order (product (s) + shipping costs if your order has been shipped in a single package).

Article 11 : Print of the logo

The logos are printed by an external company. Bagavin - Traditions & Innovations has no control or guarantee that the color of the logos conforms to that of the original. The outsourced company cannot provide a test on a material similar to Bagavin. The client therefore accepts that the result is not a true copy of the original format, moreover, since the suitcases are flocked individually there may be variations from one unit to another.

 

Article 12 : Faculty of withdrawal

A right of withdrawal is offered to the buyer under article L.221-18 to 28 of the consumer code. Upon receipt of the goods, the buyer has a period of 14 days to return the product to Bagavin.com - Traditions & Innovations SARL and request a refund. When the period of 14 days expires on a Saturday, a Sunday or a public or non-working day, it is extended until the next working day.

Products damaged after delivery will not be accepted. The buyer who uses this faculty will have the obligation to proceed, under his responsibility and at his expense, to the return of the goods ordered in the warehouse of the seller. When the goods have been sold within a promotional package, all of it must be returned to Bagavin.com - Traditions & Innovations SARL, due to the indivisibility of the order and the overall price invoiced . The seller must reimburse the purchase within 14 days, from the date on which the seller is informed of the consumer's decision to retract. We may refuse to make the refund until the goods are recovered or until the consumer has provided proof of the shipment of these goods, the date chosen being that of the first of these facts. A withdrawal form available in the Right of withdrawal section accessible on the home page must be filled and returned by email.

 

Article 13 : Force majeure

Bagavin.com - Traditions & Innovations SARL cannot be held responsible for loss, damage or delivery defects of an order resulting from a case of force majeure (such as storms, floods, road accidents).

 

Article 14 : Jurisdiction

The Bagavin.com - Traditions & Innovations SARL Customer Service is at your disposal to settle amicably any problem following an order and its execution. Complaints or disputes will always be received with attentive benevolence, good faith is always presumed in those who take the trouble to explain their situations. If it is impossible to reach an agreement, all conflicts arising from the execution of an order or the interpretation of these conditions, and more generally agreements of any kind concluded between the parties, will be assigned to the competent court. These general conditions of sale are governed for all of their stipulations by French law. The French courts will have sole jurisdiction. Possibility to contact a mediator: All consumers have the right to use consumption free of charge with a view to the amicable settlement of a dispute between them and a professional if a dispute has not been resolved in the context of a prior complaint directly introduced to the services of Bagavin.com-Traditions & Innovations SARL. Article 15 : Reservations
Bagavin.com - Traditions & Innovations SARL reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.
